UAE VAT Zero-Rated Export of Goods: Evidence Checklist

Export sales require more than a foreign customer address. The zero rate depends on the physical movement of goods, the export route, timing and evidence. Article 30 of the VAT Executive Regulation distinguishes direct and indirect exports and sets conditions for each.

Is the movement a direct or indirect export? In a direct export, the supplier or an agent acting on the supplier's behalf generally arranges the export. In an indirect export, the overseas customer or its agent generally arranges collection and export. The party controlling transport affects the evidence and representations the supplier needs.

Record the Incoterms, carrier, customs declarant, collection point, destination and person responsible for clearance. Do not determine the route only from who paid the freight. The contract and actual movement should agree.

What timing control is required? The Executive Regulation prescribes an export period and includes provisions for extensions in defined circumstances. The business should use the current Article 30 wording for the transaction date. Build a report from tax invoice date to customs exit evidence and flag items approaching the deadline.

The FTA administrative-exception service lists requests relating to evidence proving exports and extension of the time for export. An application route does not guarantee acceptance. The supplier should prepare early, submit complete evidence where a request is appropriate and avoid assuming relief.

What evidence should the supplier retain? The evidence file should identify the goods and show their departure from the UAE. Depending on the route and current rules, this may include customs declarations, exit certificates, bills of lading, airway bills, courier records, freight documents, delivery confirmation, customer declarations and commercial evidence.

Every document should reconcile to the invoice or be connected by a shipment reference. Investigate quantity, value, product, destination and date differences. Consolidated shipments need a schedule linking each sales invoice to the transport and customs evidence.

For indirect exports, obtain the required customer evidence and representations before the filing deadline. Sales teams should understand why finance cannot rely on a promise that the customer will send documents later.

How should finance reconcile exports to the VAT return? Create an export register containing invoice number, invoice date, customer, goods, value, currency, transport reference, customs reference, export date, evidence status, direct or indirect route and return period. Reconcile the register to the sales ledger, customs data and reported zero-rated supplies.

Hold incomplete items in an exception queue. The reviewer should decide whether the current evidence supports zero-rating or whether another treatment is required. Do not delete or replace source records when late evidence arrives. Preserve the history and the final decision.

What if goods move through a Designated Zone? Do not assume every movement in a free zone is outside UAE VAT. Only listed Designated Zones and qualifying transactions receive special treatment.
